RELEASE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT
In consideration of staying at, or participating in, campground activities, or both, and for other good and valuable consideration which is hereby acknowledged, we hereby agree to release and discharge from all liability Beacon Hill Camping and its owners, directors, agents, volunteers, participants and all other persons or entities acting for them (hereinafter collectively referred to as “Releasees”). This Release is effective and binding on myself, my spouse, children, parents, guests, heirs, assigns, personal representatives and estate (the “Releasors”). I further agree as follows:
- The Releasors acknowledge camping at Beacon Hill Camping and participating in campground activities involves risks (obvious or hidden) which could result in physical or emotional injury, disability, death and/or property damage. We understand such risks cannot be eliminated.
- The Releasors expressly accept and assume all of the risks inherent in any activity or that might have been caused by the recklessness or negligence of the Releasees. Our participation in any activity is purely voluntary. If any time we believe that the event conditions are unsafe or that we are unable to participate due to physical or medical conditions, then we will discontinue participation immediately.
- We, Releasors, hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all claims, demands, or causes of action which are in any way connected with our participation in any activity, or our use of their equipment or facilities, arising from recklessness or negligence. Should Releasees or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, we jointly and severally agree to indemnify and hold them harmless for all such fees and costs.
- We further represent that we have no medical or physical condition which could interfere with our safety in any activity, or else we are willing to assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition.
- In the event that we file a lawsuit, we agree to do so solely in the state or federal courts having jurisdiction over Lancaster County, Pennsylvania, and we further agree that the substantive law of Pennsylvania shall apply.
- We agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and in effect.
- The registered guest hereby represents and agrees that he or she has the right to bind the Releasors.
- The camper and guests accept camping privileges with the understanding that they carry their own liability and comprehensive insurance to protect against any and all damage such as theft, fire, windstorm, trees, limbs, nuts, water damage, hail, vandalism, injury, sickness, animals and etc. Camper and guests release the campground, its owners and employees from any and all negligence. Camper does hereby release the campground, its owners and employees of all liability for loss or damage to property and injury/sickness to his/her person arising out of their use of its camping facilities, and agrees to indemnify the campground, its owners and employees, against claims resulting from loss or damage to property or injury to the person or any member of the family or guest of the registered camper arising out of the use of its camping facilities. No subletting of sites or rentals. Failure to abide by the rules may result in early termination of your stay with no refunds.
By staying or being a guest at Beacon Hill Camping, we agree that if we are hurt or our property is damaged during our participation in any activity or stay at Beacon Hill Camping, then we may be found in a court of law to have waived our right to maintain a lawsuit against the parties being released on the basis of any claim for negligence or recklessness.
